Cyprus IP Box

Reduce the effective tax rate on qualifying intellectual property income to below 3% — one of the most competitive IP regimes in the European Union.

Overview

The Cyprus Intellectual Property Box regime, established under Article 9A of the Income Tax Law, allows qualifying taxpayers to benefit from an 80% exemption on qualifying IP profits. Applied against the standard 15% corporate tax rate, this produces an effective tax rate on qualifying IP income of 3% — and in many cases, lower once associated expenses are factored into the nexus calculation. Cyprus adopted the IP Box regime in full compliance with the OECD's modified nexus approach under Action 5 of the BEPS project. This means the regime is not merely a tax incentive — it is a sustainable, OECD-compliant framework that should remain robust against future international tax reform. The regime applies to income derived from patents, copyrighted software, utility models, and other qualifying intellectual property. It is particularly relevant for technology companies, software developers, AI businesses, gaming companies, and SaaS platforms that generate income from IP they develop or co-develop.

Who This Is For

  • —Technology and software companies generating royalty income
  • —AI and machine learning businesses
  • —SaaS companies licensing software globally
  • —Gaming companies with IP held in Cyprus
  • —Pharmaceutical companies with patent income
  • —Any business deriving income from qualifying IP assets

The ASC Approach

We begin with a qualifying asset analysis — identifying which of the client's intellectual property assets are capable of qualifying under Article 9A and the OECD nexus approach. This requires careful examination of what constitutes the qualifying IP, how income is generated from it, and what expenditure qualifies as qualifying expenditure under the nexus calculation. Where structures are being established, we advise on the optimal ownership structure, licensing arrangements, transfer pricing documentation requirements, and the substance requirements that Cyprus requires for the regime to apply correctly. For existing structures, we conduct a technical review to confirm whether the existing approach is defensible and advise on any amendments required. We prepare or review all relevant documentation, including IP Box computations, transfer pricing files where required, and the relevant Cyprus tax return disclosures. We do not simply file claims — we ensure the technical position is properly supported.
